Fox Wood Modifications Committee Meeting
Minutes of our October 14, 2004

* The Modification Committee meeting was held at 7pm on Oct 14th at Fox Hollow Country Club. The meeting was called to order by Tim Gibson. It was announced that Dick Swartzman requested to be removed from the committee, because of other obligations to our Homeowners Association. Dick's wisdom and insight will be missed. Pat Cusumano will be replacing him as a committee member.

* The meeting was attended by: Tim Gibson, Jay Demyan, Bob Niemiec, Mandy Gibson, Diane Kocienda, Antony Francis, Wendy Dong and Pat Cusumano. Unable to attend were Helen Yauger and Mike Yauger. We had eight residents from the community attend.

* A new simplified application was presented to help speed up the process of making an application. (see attached) The homeowner can send the completed application to the new Fox Wood mailbox at:

This application will soon be placed on the Fox Wood web site, so that homeowners will have easy access to an application. Jay Demyan will look into getting us a copy of a map of Fox Wood that has the lot numbers on it that we can get enlarged.

* When these applications are received by the modification committee they will be assigned to a committee member. These applications should be reviewed as soon as possible, because of the 30 day automatic approval rule. In regard to the evaluation of an application, it is important to discuss the application with the homeowner to find out exactly what is planned, and to judge the homeowner's application against the deed restrictions for compliance. There are two items to be aware of:

  1. satellite dishes should be placed on the back of the home where they can't be seen from the street (one satellite installer is telling homeowners that the dish can be place anywhere, because we don't care and aren't going to check) We are checking now and dishes should not be installed until approved, and discussed with the homeowner they are aware of the deed restrictions concerning placement.
  2. fences should not be place on easements - Jay Demyan will get us maps of the easements, so that we are aware of where and what they are. A fence should have a survey map enclosed with the application that shows where the fence will be placed.

* After applications are reviewed, they will be presented at the next modification committee meeting for approval by the committee. An approval letter to the homeowner will be written and those that are not approved will be sent to Melrose to handle. Our meetings will be held weekly or biweekly depending on the flow of applications.

* As far as the boxes of records, please hold on to them. We are searching for 2 lateral drawer file cabinets 4 drawers high and a place to store them.

* A study of the area that each committee member has been assigned will be done so that changes can be made in order to make the areas more equitable.

* Diane has done an excellent job on our database. Thank you Diane for all your hard work! As Diane updates our database, she is sending e-mails containing these updates. Please make sure that you update your copy.

* A meeting with Dave Renwick to discuss the criteria used in making modification approvals and disapprovals is being arranged. Tim is hoping to also talk with Dee Dee at Melrose concerning our process of handling modification applications. As soon as all the names and telephone numbers are obtained from Melrose we will decide how to notify the homeowners in Fox Wood. We will then place the application on the web site.

* Definitions for fences, portable basketball systems, and flag poles were approved (see attached) Other definitions to be worked on by committee members to be presented at our next meeting are:

* It was decided that existing spas and pools, with no approval letter on file, will not be pursued since it is not something that can be changed once installed. All future spas and pools will require an approval letter. An approval letter must be in the homeowners file for homeowners additions, fences, satellite dishes, solar panels, basketball hoops, repainting, new landscape beds, and gator tail.

* There were nine modification applications that were reviewed and voted on by the committee. Our next meeting will be at 6pm on Friday Oct 29th in the Trinity room at Fox Hollow Country Club House.
