Minutes of our December 9, 2004

On December the 9th at 6 PM, the Modifications Committee met at the Trinity Outpatient Center in the Community Room. Those in attendance were Tim Gibson, Mandy Gibson, Tony Francis, Helen Yauger, Mike Yauger, Bob Niemiec, Wendy Dong, and Diane Kocienda. There was one resident in attendance who came to drop off a request for a pool.

The definitions, properly termed "Architectural Standards," that were approved by the Fox Wood Board were reviewed with the Modifications Committee members. It was explained that all the Architectural Standards were approved except for one sentence in the definition for landscaping and that involved the 8' height of hedges, which was removed from the definition. Those Architectural Standards approved were fences, basketball hoops, flagpoles, play gyms and swing sets, landscaping, lawn ornaments, ponds and water fountains, wells, sidewalks and driveways, repainting of house, solar panels, landscape curbing, structural additions, pools. spas, ground and landscape lighting, screening (front porch, door, garage, lanai), and PODS.

Wendy Dong did research on wells to determine if having them in our neighborhood could cause sinkholes. She explained to us that yes they can cause sinkholes, but that they are still issuing permits to have wells. She also told us that probably not enough water was removed to do lawn watering to cause a problem.

The Fox Wood Board also approved our letter to send to the residents that we know, according to our survey and the review of our records do not have approval for some items noted on their property. This will allow us to update our records for those items residents have added or installed without review and approval. This process will begin after the first of next year. It is a major undertaking and will take a lot of work on our committee's part to get the mailing ready and then to check out all the requests when they come in.

Diane and Mandy will make sure what lots need to be surveyed, so that after January 1st we will be ready to send out the letters for non approvals noted in the survey. There are two areas that have not been completed, Tony and part of Pats. Bob Niemiec, Helen Yauger, Mike Yauger, and Wendy Dong volunteered to work on these. Diane and Mandy will get the exact streets to be covered to Helen and she will distribute them.

The Architectural Standards have been submitted to Dave Renwick for the approval of the Trinity Master Association. We are waiting to hear from Dave.

There were 3 other Architectural Standards that were discussed slabs, hurricane shutters, and satellite dishes. Mandy presented information that she received from the FCC concerning satellites dishes and deed restricted communities. The FCC explained that we are completely within our rights to request that satellite dishes be placed, so as not to be seen from the street, as long as it doesn't interfere with reception. When residents move into a deed restricted community they should be aware that there are rules and regulations must be followed.

There were ten requests approved and two requests needed a letter requesting more information. New Requests for Approval were handed out.

There was a discussion about golf carts on our streets as to whether it is legal, since they are not licensed. The concern is that there are children being driven to and from school on these golf carts during a busy time. As this is not within the purview of the Modifications Committee, this will be referred to Deed Restrictions and the Fox Wood Board.

Our next meeting will be Thursday, January 6th, 2005 at 6:30 PM at the Trinity Outpatient Center. It isn't confirmed yet, as soon as it is I will let you know.
