The Fox Wood at Trinity Community Association Modifications Committee meeting was held at 6:30 PM at Trinity Outpatient Center on Jan. 6th, 2005. Those in attendance were: Tim Gibson, Mandy Gibson, Helen & Mike Yauger, Bob Niemiec, Diane Kocienda, and Wendy Dong. Jay Demyan was also in attendance.

Pat Cusumano sent an email earlier in the day resigning her position on the Modification Committee.

A copy of the Architectural Standards that were approved by the Board of the Fox Wood Homeowners Association and by Adam Smith Enterprises (ASE) was given to each committee member. These standards will be used in the review and approval process for all modification requests.

• Request to repaint a house dark blue was denied - Dave Renwick was consulted and he advised that earth tones were the choice of colors for Fox Wood. He also stated blue and yellow always turned out much darker than the color swatches indicate - it is also very important to make sure that there is not a duplication of colors on houses as close as 3 houses from the one being painted. Mandy will try to get the color samples used by each of the builders in Fox Wood: Samuelson, Rutenburg, Nohl Crest, Greene, and MI. If not available we will get samples from Wal-Mart, Sherwin Williams, Benjamin Moore, Lowes, and Home Depot to develop the Fox Wood color palette.

• Tiki huts are not allowed - A letter has been sent to the owners of the home on Winsloe to remove the two structures in the backyard that were not approved. It was also noted there is another tiki hut in the backyard of 1705 Blue Beech. This will be passed on the DRE Committee.

• The fence constructed on Larkspur did have an approval letter even thought it was not in our files. We need to get letter and request forms from Melrose for the lot files so that this does not occur again. Letter have been secured with form to follow.

• There is a weathervane on the roof of a home on Cassia. Only vents on the roof or similar devices are acceptable. A letter requesting the removal was sent to the homeowner.

• On Larkspur there is a house with a screened front porch, which is not allowed in Fox Wood. The builder of the home, (Samuelson Builders), installed the screen on the front porch, and we have requested that the builder remove the screen before the house is sold.

• The two pools on Larissa and Cardamon that were started without approval have made applications and they were approved. The Cardamon (1946) site is a good example of properly managing the dirt on the sidewalk situation. Several times passing by have revealed no dirt on the sidewalk. This was noted in the letter of approval to the homeowner.

• Outside storage containers are not allowed and should be denied - the two not approved on Winsloe and Northridge have been removed.

• It was noted that the 2332 Winsloe still has the storm shutters up. This is being passed on the DRE Committee.

• There was a review of the Architectural Standards under development. There included storm shutters, screening, and satellite dishes (already approved). These standards need to be finalized and presented to the Board for review and acceptance. They will then be presented to ASE for review and acceptance. Below are these definitions.

• Storm Shutters: The job of any storm shutter is to protect your glass areas from breakage when hit by flying debris. There are many styles and types of both permanent and temporary shutters.
  
  1. Permanent shutters such as Roll-Up, Colonial, and Bahama come closest to maintaining the architectural integrity of your home. Roll-Up shutters, due to their ease of operation can also be used for security, light and sound control, and insulation. Al permanent shutters, including any not mentioned above, require the prior approval of the Modifications Committee before installation.
  2. Temporary shutters, such as corrugated panels and plywood, require some planning and effort to install and remove. In addition, provisions need to be made for their proper storage (out of sight) when not in use. Temporary shutters can be installed seven days prior to the projected arrival of a storm to impact our area. The removal and storage of temporary shutters should occur within seven days after the storm has passed. Due to the time sensitive nature of temporary shutters, prior approval of the Modifications Committee is not necessary. However it is necessary to adhere to the installation and removal timing noted above.
  
  
• Screening (front porch, doors, garage): Screening of front porch areas is not allowed within the community in order to maintain the architectural integrity and a uniform appearance of Fox Wood. Screen doors on entryways and on garages must have prior Modifications Committee Approval. Submit plans, sketch, or drawing with applications. Front doors that are screened should be in colors that are acceptable and should be compatible with the door and door jam assembly.

• Satellite Dishes: (10.03.12 and amendment dated 7/18/97 replacing 10.03.12 in the deed restrictions book) Property owners are permitted to install satellite dishes or antennas on a permanent basis provided the satellite dish or antenna complies with the Telecommunications Act of 1996, pare II of Title III, Section 207. The following shall also apply:
  
  1. No satellite dish or antenna shall be larger than 1 meter (39").
  2. Satellite dishes and antennas should be laced toward the rear of the house or on the roof to minimize visibility from the street.
  3. If visible from the street, the equipment should be landscaped to minimize visibility.
  
  
• Wendy noticed that some homes have built a wall to shield the garbage cans from view. It was discussed as to whether this was all right. The Committee agreed this was, acceptable, but if someone is building a wall it needs to have a Modification Application approval on file.

• Everyone was asked to look through the Deed Restriction Book before our next meeting, and see if there are any more deed restriction items that need to be addressed by our committee and have clarifying standards developed.

• There was a discussion about the safety of golf carts on the streets of our community, especially when children are being taken to and from school. This matter has been brought to the attention of the Fox Wood HOA Board.

• Mandy brought up a call that she received from Glenn Dexter on Eveningwood concerning building a wall to help block out the noise and lights from Trinity Blvd. We could have a problem is everyone starts trying to correct the problem themselves. It was suggested that the following be presented to the Fox Wood Homeowners Association: It appears that the homeowners are going to come up with ways to block the noise and lights if something isn't done. Because the road was raised to prevent flooding, the present wall isn't tall enough to efficiently block the lights from cars at night, or the traffic noise all the time. Solutions suggested are as follows: 1) make the wall taller or 2) plant pine trees along the outside wall to help block both the lights and noise.

• Modifications Applications approved at our meeting were eight (8) and two (2) are on hold for additional information. The approvals included:
  
  1. Lusterleaf - birdbath
  2. Balsaridge - gator tail
  3. Firefern - pool and screen enclosure
  4. Northridge - pool and screen enclosure
  5. Cardamon - pool and screen enclosure
  6. Cardamon - landscaping
  7. Edelweiss - pool and screen enclosure
  8. Broadleaf - small pond with waterfall, lawn ornaments, lighting
  
  The two applications on hold are as follows:
  
  1. Winsloe - color swatches needed
  2. Hammock Park - location of solar panels due to trees

• A discussion was held on how to handle the distribution of the letters that need to be sent to homeowners who have items noted in our survey that are not approved. Jay noted that there was a Sly Fox going out around February 11 and that maybe we could include the Architectural Standards as well as a Modifications Application with their mailing. Several suggestions were made as to how to get the letters to the residents that have items that are not approved.
  
  Have the block captains deliver the letters personally to the residents
  Check churches and hospitals to see about a bulk mailing through them
  We will have to mail to those homeowners whose address is different from the resident
  Have committee deliver the letters
  Use the post office - Mandy will check with the post office and determine the cost for each letter, as well as the cost of mailing just the letter and an application.
