In
order for an owner to vote in an election held by the Fox Wood at
Trinity Community Association, the person casting the ballot must
satisfy the requirements of Section IV, paragraph 4.02 of the
Covenants, Conditions and Restrictions. The requirements are summarized
below:
Each Lot is entitled to one vote.
If
the Lot is owned by a husband and wife as tenants by the entirety,
either party may vote, unless one party has filed a statement with the
Secretary raising an objection to the other party voting. In the case
where an objection has been filed and for any other form of ownership,
a Voting Certificate must be on file with the Secretary of the Board of
Directors designating who is authorized to vote for the Lot (or if the
property is owned by multiple individuals, all owners can sign in lieu
of a Voting Certificate). If a Voting Certificate is required but is
not on file with the Secretary, no vote may be cast for that Lot,
unless all owners listed on the deed sign the ballot.
